TERMS & CONDITIONS
AGREEMENT: All guests and occupants (“the Guests”) of the property (“the Property”) acknowledge, understand, and agree that the moment their credit card details are provided for the Initial Reservation Payment, and/or taking possession of the Property, they have accepted the Anna Maria Island Accommodations, Inc’s (“AMIA”) Terms and Conditions (“The Terms and Conditions”), to include our Cancellation Policy, regardless of whether a signature is provided. AMIA, in its sole and absolute discretion, may choose not to accept a reservation if it does not meet certain criteria such as, but not limited to, a minimum number of nights, not beginning or ending on a certain day during particular times of the year, and not meeting certain criteria for Holiday periods, dogs not meeting the Property’s parameters. These Terms and Conditions may be modified from time to time.
PAYMENTS: Reservations can be made online, by phone, or by email. The Guest authorizes AMIA to charge the provided credit card for the Initial Reservation Payment. The Initial Reservation Payment is 25% of the Rental Fee and is due at the time of booking. This is a Payment towards the total cost of the reservation and NOT a Refundable Security Deposit. The remaining balance must be received no later than 60 days prior to the arrival date and can be made by credit card, check, e-check, and bank wire transfer (wire fees may apply). Reservations made within 60 days of arrival must be paid in full at time of booking by credit card. All prices are quoted in US Dollars. All reservations will include a Reservation Fee, Accidental Damage Waiver Fee (or Security Deposit), Cleaning Fee, and Linen Fee. A Dog Fee will be applied to Guests’ reservations at participating dog friendly properties. Dogs must be disclosed and approved by AMIA prior to arrival. All fees are subject to a 12% Sales and Resort Tax. The Travel Protection premium is due at the time coverage is elected.
CANCELLATION POLICY: All cancellations must be received in writing. Please email your cancellation request to email@example.com, along with your name, confirmation number, and dates of stay. The original PDF confirmation you received from AMIA is also acceptable. A confirmation of the cancellation will be emailed once the cancellation has been processed. All cancellations are subject to a $100 cancellation fee.
REFUNDS: Refunds are subject to AMIA’s ability to re-rent the Property for the originally contracted Rental Fee. If the Property is re-rented, AMIA will issue a refund in the amount for which it was re-rented, minus the $100 cancellation fee. If the Property is re-rented for a lesser amount, the Guests will be responsible for the difference in the value of the originally contracted Rental Fee and the re-rented Rental Fee. No refund will be given if AMIA is unable to re-rent the Property. AMIA does not make any sort of guarantee that it will be able to re-rent the Property, or re-rent it for the original contracted Rental Fee, but AMIA will make every effort to do so. No refunds will be issued for non-arrival, late arrivals, early departure or alteration to the Reservation. AMIA strongly recommends Trip Insurance to cover unforeseen circumstances.
TRAVEL PROTECTION INSURANCE: AMIA is proud to offer travel insurance through CSA Travel Protection and strongly recommends that Guests purchase the Travel Coverage. In case of unforeseen events, this insurance may help protect your vacation investment. The plan is optional and can be declined during the reservation process if you so choose. The travel protection, if purchased, provides reimbursement for unused, nonrefundable payments if your trip must be cancelled or interrupted. Covered reasons include: mandatory hurricane evacuations; sickness, injury or death; extension of school year; armed service revocation; involuntary termination of employment or other specific reasons listed in the policy/Description of Coverage. Underwritten by GENERALI US Branch, A Stock Company. The Travel Protection premium is due at the time coverage is elected. From the time of purchase, the CSA Travel Protection plan includes a designated 10 day Free Look period in which you may cancel your plan for a full refund if it doesn’t suit your needs.

FORCE MAJEURE ACTS OF GOD/NATURE: AMIA will work diligently to ensure Guests stay is pleasant. However, AMIA will not be held liable or issue refunds for circumstances beyond its control. This includes but is not limited to inclement weather, hurricanes, red tide, fire, pandemics, and any other acts of nature. AMIA strongly encourages your purchase of Travel Protection Coverage.
PROPERTY DAMAGE: In an effort to provide the best possible experience, Guests should notify AMIA of any and all damages to the Property immediately upon arrival. Immediately reporting damages to AMIA will help to prevent Guests from being charged for damages in error. Guests will be financially responsible for damages to the Property and its contents during their dates of occupancy, with obvious exclusions such as Acts of God/Nature and damages deemed as normal wear and tear. AMIA requires an active credit card on file to be used in the event of Property or contents damage.
ACCIDENTAL DAMAGE WAIVER FEE OR SECURITY DEPOSIT: When an online reservation is made, the Accidental Damage Waiver Fee is automatically charged. If Guests opt to pay a Refundable Security Deposit in lieu of the Waiver, they may contact the AMIA Reservations team for this adjustment to their reservation. The Guest who uses their credit card for the Initial Reservation Payment is considered the responsible party, and all necessary charges associated with their rental will be charged to their credit card on file for the Rental Property, regardless of who in the Guest’s party caused the damages.
Accidental Damage Waiver: If the non-refundable and limited Accidental Damage Waiver (which is defined as a sudden and accidental event that causes property damage) is selected, then a $59 fee will be added to the reservation. In addition to the Fee, AMIA requires an active credit card on file. This fee protects the Guests from being financially accountable for a portion of the accidental damage that may occur during their dates of occupancy. This does not include damage to the Property that is deliberate, intentional, or as a result of illegal or negligent acts. The Accidental Damage Waiver is forfeited if the Guests fail to report property or contents damage prior to departure or fail to comply with the Terms and Conditions of this Agreement. Such acts to warrant forfeiture would include but are not limited to; exceeding the maximum occupancy of the Property, unauthorized pets, and failure to comply with any known property specific policies. The Accidental Damage Waiver Fee does not cover unreported accidental damage, intentional damage, damage due to misuse, theft, damage caused by smoking, damage caused by a dog, extensive cleaning required upon departure, linens that are damaged or missing, charges resulting from violation of any law, ordinance, or regulation, any fines or costs levied against Guests or visitors of Guests. In the event the Guests accidentally damage the Property or its contents, the Damage Waiver will provide coverage/relief not to exceed $500. Guests remain responsible for any accidental damages in excess of $500. Guests will be notified of any damages and associated costs by email. Guests agree that AMIA is authorized to charge the active credit card on file for any accidental damage over $500. Please note again that the Accidental Damage Waiver does not include intentional damage and that AMIA requires notification of any and all damages prior to Guests’ departure.
Refundable Security Deposit: Guests may opt to pay a $1500 Refundable Security Deposit in lieu of the Accidental Damage Waiver Fee. This will be collected at the time the reservation is made and will be in addition to the 25% Initial Reservation Payment. The Security Deposit will be retained by AMIA for approximately 2 weeks from the date of departure. Guests are obligated to inform AMIA of any and all damages prior to departure. In the event of unreported damages, Guests will be notified by email and provided with documentation detailing damages and associated costs. If repairs (reported or unreported) are needed, all or a portion of the Security Deposit will be forfeited to cover the cost of the repairs. Guests agree that AMIA is authorized to charge the active credit card on file for any damage exceeding the $1500 Security Deposit. Guest will also be notified by email that all or a portion of their Security Deposit will be forfeited for such occurrences as but not limited to; theft, damage caused by smoking, extensive cleaning required upon departure, linens that are damaged or missing, charges resulting from violation of any law, ordinance, or regulation, any fines or costs levied against Guests or visitor of Guests.
RENTAL RATES: Rental rates are subject to change without notice. Rates on confirmed reservations will not be changed unless additional dates are added to an existing reservation. The rate and rental listing information provided online, though deemed accurate is not guaranteed. It is subject to errors, omissions, change of price or withdrawal without notice.
CHECK-IN AND CHECK-OUT TIMES: Check-in is after 4:00 PM and Check-out is before 10:00am. Detailed arrival and Check-in instructions will be included in the Rental Confirmation.
PROPERTIES FOR SALE: In the event that the Property that the Guests have rented is for sale, it may be necessary to have a realtor show the Property to a prospective buyer during the Guests stay. Our policy is to provide the Guests with a 24-hour notice. AMIA will make every effort to limit the number of showings and attempt to conveniently schedule the showings in an effort to not disturb the Guests vacation. Guest acknowledges that the acceptance of these Terms and Conditions includes agreeing to cooperate with showing requests during their stay. Guests also understand that in the event of a sale of the Property, the new Owner may not be contractually bound to honor existing reservations. In this event, AMIA will notify the Guests prior to arrival to offer an alternate property. Guests will be entitled to a full refund of all payments made if alternate properties are not available or suitable.
ENTRY OF PREMISES: Although AMIA will make every attempt possible to notify you, AMIA reserves the right to enter the Property for periodic maintenance, repairs, improvements, to investigate disturbances, or to verify occupancy.
OCCUPANCY: The individual entering into the rental agreement must be at least 25 years of age and must occupy the Property the full length of the rental term. Guests who violate this policy are subject to immediate eviction and forfeiture of all rental payments. Maximum allowed occupancy depends on the property rented and is listed on the reservation confirmation. Over occupancy, parties, weddings/receptions, and other gatherings or events are strictly prohibited and will result in immediate eviction without refund. The Guests shall comply with all applicable laws and governing homeowners and/or condominium associations, and promptly comply with governmental order or directive for the correction or prevention of any violation of applicable law in connection with the Guests’ stay at the Property.
NOISE ORDINANCE: Anna Maria Island has a noise ordinance that is enforced by local law and code enforcement officers which is in effect from 10pm to 7 am. Please be mindful of the noise level, music, and pool activities within this time frame. Failure to adhere to the noise ordinance could result in fines and immediate eviction. AMIA requests that Guests be considerate of the neighbors with their noise and activities.
FINES AND PENALTIES: Guests will be responsible for any and all fines, penalties, or citations assessed, either at the time of incident or after departure, to them individually, to the Property, or to AMIA during their dates of occupancy including, but not limited to, noise, parking, and trash violations.
AMENITIES: Please note that amenities vary by property as each property is individually owned and therefore reflects the taste of each private owner. Amenities can also change from time to time. AMIA shall not be responsible for providing additional furnishings or equipment and will not be liable for changes made to properties or errors on the AMIA or any third-party marketing websites. A startup of paper goods is provided for our guests that include: dishwasher detergent, hand soap, toilet paper, paper towels and a trash liner. Any supplies beyond this are to be supplied by the guest.
SUBSTITUTION OF PROPERTY: Should unforeseen circumstances arise that are beyond AMIA’s control, (sale of Property, fire, damage, etc.) AMIA reserves the right to substitute the Property. In this event, AMIA will notify the guest prior to arrival to offer an alternate property. Guests will be entitled to a full refund of all payments made if alternate properties are not available or suitable.
DOG FRIENDLY HOMES: AMIA has an inventory of dog friendly properties. Please contact AMIA for additional information. All dogs, including service animals must be disclosed and approved prior to arrival. An additional fee of $150 plus tax will be applied to all reservations bringing a dog. Dogs are not allowed in the pool/spa or on furniture. Guests are responsible for picking up after the dog as well as any additional fees that are incurred due to damages and additional cleaning. Please note that AMIA does not allow cats at any of our properties. Guests who violate this policy or bring a dog to a non-pet friendly home are subject to immediate eviction and forfeiture of all rental payments.
NON-SMOKING: All AMIA Properties are Non-Smoking. Without exception, smoking is not permitted at Property to include smoking on balconies and patios. Failure to comply will result in a $500 charge. AMIA reserves the right to charge the credit card on file for violations of the Non-Smoking Policy.
TRASH: Your trash pick-up days will vary depending on the municipality in which the Property is located. Please refer to the property book for more information. Trash and recycle containers need not be taken to the curb as the Properties are on side-door pick-up service. Containers must be close to the home, in plain sight from the road as the waste trucks drive by, and accessible to the trash pick-up personnel. If the cans are not emptied as scheduled, Guests should notify the AMIA office.
RECYCLING: The trash containers are cleared labeled. Guests should call the AMIA if they are unable to distinguish which cans are for recycling and which cans are for trash. Please do not put trash in the recycling bins. DO NOT bag up your recyclables. Recyclables must be loose in the recycling bins. Guests will be responsible for any charges or fines associated with improper placement and usage of trash containers. Guests will also be responsible for any charges related to AMIA staff having to rectify improper placement of trash during or immediately following their departure.
FAILURE OF EQUIPMENT: Please notify AMIA immediately in the event of any equipment malfunction or maintenance issue. AMIA will attempt to make repairs in a timely manner. Guests expressly waive and relinquish any rights or claims against the Property Owner or AMIA for inoperable equipment. Discounts or refunds will not be issued due to inoperable equipment. Should a repair service make a visit to a rental property and find the equipment is not in working order due to Guests misuse, oversight or neglect, the fee for the service will be charged to the guest.
POOLS: Pools are heated from November through May or as conditions warrant and are set to approximately 83 degrees at no additional cost to the guest. AMIA will attempt to ensure that the pool stays in the set range; however, AMIA shall not be held liable for extreme weather or inoperable equipment. When the ambient temperature falls below 60 degrees, the pool heater may not operate as it normally would and may even shut down. Pool heaters only run when the pool pump is running. The pools are residential pools and are serviced a minimum of one time per week with a varied schedule. For convenience, AMIA provides a pool skimmer to remove debris in between cleaning days. Please note that pool service technicians will have access to the pool area and may not always be heard when they arrive to service the pool.
CONSTRUCTION: Please note that AMIA cannot predict nearby construction and are not notified of future, current, or ongoing construction. Therefore, AMIA or the Property Owner shall not be responsible to provide any advanced notification in the event of construction or construction noise beyond the confines of the Property. Audible construction noise shall not void this agreement nor shall it serve as a basis for claim for relocation, refund, price reduction, or other compensation.
LOST AND FOUND: It is the Guests responsibility to check the property thoroughly prior to departure. AMIA shall not be liable for any personal items left at the Property by the Guests. AMIA will make every effort to locate and return any left-behind item. Guests will be responsible for any shipping charges incurred with a $25 minimum fee.
WAIVER/LIABILITY/INDEMNIFICATION: The Guests hereby waive and release, and shall indemnify and hold harmless, the Property owner and AMIA, its principals, officers, owners, agents, and employees from any and all liability, claims, damages, causes of action, and/or any costs and expenses related, directly or indirectly, to the Property and/or the Guests, their guests, and invitees at the Property, including, but not limited to, the condition of the Property, property damage, theft, and injury to or death of any Guests, their guests and invitees.
In the event of any legal proceeding to interpret or enforce the terms of these Terms and Conditions, the prevailing party shall be entitled to an award of its reasonable attorneys’ fees and costs incurred during such proceeding, including trial, appellate and bankruptcy courts.
These Terms and Conditions shall be construed in accordance with and governed by the laws of the State of Florida. Venue for any dispute concerning the Terms and Conditions shall lie solely and exclusively in Manatee County, Florida.
